Gulf News reports that Dubai Civil Court ordered the airline to pay the amount in moral and materialistic compensation on Monday plus a 9 per cent legal interest to be paid annually. Lawyer Mohammad Al Hashemi had sought Dhs74m ($20.1m) to be paid to his clients arguing the deaths of their parents were due to crew error. Based on preliminary findings revealed by a primary investigation report, the crash was a result of a professional error by the crewmembers,” he was quoted as saying. “Consequently, the claimants have the legal right to seek civil compensation against their accrued damages.” In April 2016, Russia’s Interstate Aviation Committee called for Flydubai to review “go around” training after indications the pilot had become disoriented having been forced to abort his first landing attempt. After the time to settle the dispute expired the two had the right to sue the carrier under UAE law. Following this, General Civil Aviation Authority experts were commissioned to look into the case and any insurance policy applying to the siblings. The lawyer said the two were seeking Dhs36m ($98m) for each parent’s death but the court ruled the Dhs800,000 plus interest was sufficient. Al Hashemi said he was planning to appeal the ruling. Flydubai is also expected to appeal. Those that died in the incident included 44 Russian, eight Ukranian, two Indian and One Uzbek passengers, seven crewmembers and two pilots. 0 Comments
